Important Guidelines When Resigning in the Philippines:

  • The 30-Day Notice Rule: Under Article 300 (formerly Article 285) of the Philippine Labor Code, an employee must serve a written notice to the employer at least one month (30 days) in advance. Failing to do so without a valid just cause may expose you to liabilities for damages.

  • Exceptions to the 30-Day Notice: You can resign with immediate effect without serving the 30-day notice under specific legal grounds, such as serious insult by the employer, inhuman treatment, commission of a crime against the employee, or other analogous causes.

  • Clearance and Final Pay: Make sure to complete your company’s clearance form, account for all company property, and coordinate your exit interview to ensure the smooth release of your final pay and government clearances (BIR Form 2316, SSS, PhilHealth, Pag-IBIG).
